People who are unfamiliar with purchasing photographic images are surprised to learn the purchaser is actually buying a photo licensing agreement for the use of the image, or images. The licensing agreement is between you (the purchaser), and Teri J. Surratt/Teri J. Surratt Photography (photographer). This is the standard method used to transfer usage rights to someone other than the creator of the image (photographer - content creator).
Under Copyright Law the copyright inherently remains with the creator/artist of the content from the moment of it's inception. A photo licensing agreement allows the copyright holder, (the photographer), and licensee (the purchaser), to clearly define the ways in which an image can be used. This protects both parties and allows for a mutually beneficial professional relationship.
Below please find the Terms and Restrictions for my “Standard Usage License Agreement”. By purchasing an image(s) you are agreeing to all terms of this agreement.
Every file I transfer to you comes with my “Standard Usage License Agreement”. If you would like additional rights they may be purchased for an additional fee. Unless you've purchased “Extended Rights” your use of the content will be subject to these standard licensing terms.
You can use images in any way that is not restricted (see below). Subject to those restrictions and the rest of the “Standard Usage License Agreement” agreement Teri J. Surratt/Teri J. Surratt Photography hereby grants these rights:
Non-exclusive, meaning that you do not have exclusive rights to use the content. Teri J. Surratt/Teri J. Surratt Photography can use image(s) for self promotion. After three calendar years, Teri J. Surratt/Teri J. Surratt Photography can license the same image(s) to other customers, or sell the image(s) to stock photo sites.
No expiration date, meaning there is no end date on your rights to use the content.
Unlimited usage, meaning you can use the content in an unlimited number of projects and in any media.
Examples of how you can use licensed content include: websites; blog posts; social media; advertisements; marketing campaigns; mugs; t-shirts; pens; tote-bags; magazines; books; web and mobile applications.
Usage Area is regional, and is limited to San Diego County only. If an image is used for in/or on an establishment outside of San Diego County, or if it’s used for marketing purposes which has a distributorship outside of San Diego County and additional usage license and fee are required.
Fee or payment for License, the fee for my “Standard Usage License Agreement” is included the price of each image. Half of the total price of each image is the price for the “Standard Image License”.
License is granted to the purchaser of the images specifically, No other interests or additional companies the purchaser of the image may own or be part of is licensed to use images.
By purchasing images the purchaser is bound by the terms of this agreement.
No Unlawful Use. You may not use images in a pornographic, defamatory or other unlawful manner.
No False Representation of Authorship. You may not claim that you are the original creator of the image, if that art is made up largely of the licensed image. For example, you cannot create a work of art based solely on the licensed image(s) and claim that you are the creator of the image.
The rights granted to you are non-transferable, meaning that you cannot transfer or sublicense them to anyone else. Except to:
Subcontractors. You may allow subcontractors; for example, your web marketing company, your print company or distributors to use the image(s) in any production or distribution process related to your final project or end use. These subcontractors and distributors may not use the image(s) for any other purpose.
Teri J. Surratt/Teri J. Surratt Photography may use the image(s) in printed materials, social media and website for self promotion. Only after three calendar years Teri J. Surratt/Teri J. Surratt Photography may license the same image(s) to other customers, or sell the image(s) to stock photo sites.
All of the licensed content is owned by Teri J. Surratt/Teri J. Surratt Photography. All rights not expressly granted in this agreement are reserved by Teri J. Surratt/Teri J. Surratt Photography.
